This website (the “Website”) is owned and operated by Lenny Learning Inc., a 501(c)(3) nonprofit organization (“Openbrook”, “we”, “us”). Openbrook provides this Website, including all information, tools, and services available to the user (“User”, “you”), conditioned upon acceptance of all terms, conditions, policies, and notices stated in these Terms of Use (“TOU”).
1. Acceptance of Terms
By accessing and using the Website, you agree to be bound by all provisions of this TOU. These terms constitute the exclusive agreement between Openbrook and you regarding any interactions in connection with the Website. Openbrook may modify these terms at any time in its sole discretion. Continued use of the Website constitutes acceptance of the then-current TOU.
2. Access and Accounts
To access some features of the Website, you may be asked to provide certain information, including personally identifiable information. It is a condition of use that all information you provide be correct, current, and complete. All information you provide is governed by our Privacy Policy.
If you are provided with login credentials, you must treat them as confidential and not disclose them to any other person. Openbrook reserves the right to disable any credentials at any time for any reason.

In no event shall the total liability of Openbrook exceed one hundred ($100.00) U.S. dollars.
8. Indemnification
You agree to defend, indemnify, and hold harmless Openbrook, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses arising out of your violation of this TOU or your use of the Website.
9. Governing Law
All matters relating to the Website and this TOU shall be governed by the laws of the State of New York without regard to its conflict of laws provisions. You agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the Southern District of New York.
10. Limitation on Claims
Any cause of action or claim you may have arising out of or relating to this TOU or the Website must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
11. Changes to Terms
Openbrook reserves the right to modify these terms at any time. We will update the effective date at the top of this page. Your continued use of the Website following any changes constitutes acceptance of the revised terms.
